Defending Misdemeanor Crimes in Illinois

With misdemeanor crimes, particularly first offenses, it is often possible to have the charges dropped completely or negotiate for court supervision. Court supervision is the next best outcome to beating the charges because it will result in a case dismissal if properly completed. In Illinois, there are three classes of misdemeanors. They include:

  • Class C Misdemeanors – Punishable by up to 30 days in jail and up to $1,500 in fines. (i.e. aggravated assault, battery, domestic battery, driving with a suspended license, retail theft, DUI, possession of cannabis (over 10g but under 30g), possession of drug paraphernalia, public indecency, prostitution)
  • Class B Misdemeanors – Punishable by up to 6 months in jail and up to $1,500 in fines. (i.e. possession of cannabis (over 2.5g but under 10g), criminal trespassing, harassment by telephone)
  • Class A Misdemeanors – Punishable by up to 1 year in jail and up to $2,500 in fines. (i.e. disorderly conduct, possession of cannabis (under 2.5g), assault)
